Devos Drops Appeal In Fight With NEA Over Online College Rules – Politico

The Trump administration is abandoning its appeal of a court ruling earlier this year that struck down Education Secretary Betsy DeVos’ attempts to delay Obama-era rules for online colleges.

— The Justice Department on Friday moved to dismiss its appeal that was pending before the 9th Circuit Court of Appeals. The appeal had challenged a lower court’s April ruling, which is now forcing the Trump administration to implement the Obama-era standards for how state regulators must oversee online college programs.

— DeVos’ decision to end her appeal comes after she called on the plaintiffs—the National Education Association, the nation’s largest teachers union, and its California affiliate—to drop the case. DeVos had publicly blamed the NEA’s lawsuit for jeopardizing federal financial aid to tens of thousands of students in California last month.

— Education Department spokesperson Liz Hill said: “Our final rule that fixes the problems with the previous administration’s regulations will be in place long before the appeal is decided In the interim we will continue to work with states to protect students until our final rule is published.”
